Unidroit Arbitration Rules

It is difficult to imagine a more illustrious meeting of experts in international trade law than the one held at the International Chamber of Commerce in April 2001. The objective of the meeting was to review UNIDROIT`s principles relating to international trade treaties seven years after their promulgation. These principles are intended to establish a generally acceptable standard in international contract law. It is therefore understandable that they are closely related to international arbitration, the preferred method of dispute settlement in the world of international business. Indeed, international arbitrators have been the most receptive to the principles, as evidenced by the considerable number of arbitral awards in which they are mentioned. UNIDROIT`s principles of international commercial contracts, such as international commercial arbitration, are the result of private initiatives that reflect the desire of lawyers and businessmen to facilitate cross-border commercial relations by going beyond the sometimes limited perspective of national laws and procedures. The value of the principles has been recognized not only in practical situations of contract negotiation and dispute resolution, but also as a potential resource for legislators. It is therefore important to regularly review the way they are used to see how they can be further developed. To this end, the International Institute for the Unification of Private Law (UNIDROIT) and the International Court of Arbitration of the International Chamber of Commerce organized the seminar in 2001, inviting academics and practitioners to exchange views before UNIDROIT continued the work of the past decade.
